We have often been asked in recent days to which professional categories of the health sector the obligation of the anti-Covid-19 vaccination is addressed and with this pill we try to clarify as much as possible.
Here, of the entire Law Decree 44 of 1 April 2021, we take into consideration only and exclusively Article 4 which is the one of interest and let's read a part of the first paragraph:
"... in order to protect public health and maintain adequate safety conditions in the provision of care and assistance services, health professions and health professionals who carry out their activities in health, social and social welfare structures , public and private, in pharmacies, parapharmacies and professional offices are obliged to undergo free vaccination for the prevention of SARS-CoV-2 infection "
In this paragraph it can be understood that the obligation is therefore referable to two very specific categories recognized by the Italian legal system: the health professions and health care workers.
Here is the list:
1.0 Healthcare Professions
1.1 Healthcare Nursing Professions
- Pediatric Nurse
1.2 Obstetric Healthcare Profession
- Midwife / o
- Health Technician of Medical Radiology
- Audiometrist Technician
- Biomedical Laboratory Health Technician
- Neurophysiopathology technician
- Orthopedic Technician
- Hearing aid technician
- Technician of Cardiocirculatory Pathophysiology and Cardiovascular Perfusion
- Dental hygienist
1.3 Healthcare Professions Of Rehabilitation
- Speech Therapist
- Orthoptist - Assistant of Ophthalmology
- Neuro and Psychomotricity Therapist of the Evolutionary Age
- Psychiatric Rehabilitation Technician
- Occupational Therapist
- Professional educator
1.4 Healthcare Professions Of Prevention
- TTechnique of Prevention in the Environment and in the workplace
- Health care assistant
2.0 Healthcare worker
- Operator social health
- Dental Practice Assistant
As you can see, the professions involved are 33 and instead does not refer to the so-called auxiliary arts of the health professions (including, for example, the dental technician and the pediatrician), which therefore should be considered excluded from the area of obligation and in any case must refer to professions performed in the areas listed in the decree itself.
This pill obviously fails to shed light on the real application of this vaccination obligation, and the regulatory gaps contained in the decree do not help since it is not enough to be in one of these categories to be subject to the obligation and we cannot exclude that these borders do not are overcome by variegated and colorful interpretations, future amendments during the conversion into law or explanatory circulars of the Ministry of Health in the style of the Lorenzin Decree.
